Background:

         This website exposes the East Lake Sammamish federal tax fraud scheme, explains how it happened, and suggests what we-the-people should do to keep it from happening again. The tax fraud scheme is the basis of all the criminal activity and corruption I describe on this website.

         This page contains suggestions for action that you, the reader, should take if you are offended by the crimes and dishonesty I describe and document on this website. On my home page, I propose solutions that need to happen, but are a mix of general actions and goals without a suggested path to that accomplishment. My suggestion is that you write your elected representatives and ask for the impeachment of the judges and politicians who have participated in the ELS tax fraud.          There is no hope that the federal and state officials who participated in the ELS tax fraud scheme will clean up the cesspool of corruption which they have created. If the citizens of the State of Washington want to live under a system of Constitution and laws, and leave an orderly society for their children and grandchildren, then they must demand the participants in the East Lake Sammamish federal tax fraud scheme be held accountable for their crimes. This is particularly true of the judges who have intentionally committed this crime from the bench.

We must impeach the judges who participated in the East Lake Sammamish federal tax fraud scheme.

         First, it is important for folks to understand the role of judges in our society. Our judges are "hired help" who we assign the task of protecting and defending our Constitution and laws. We don't ask them to make our laws. We instruct them to enforce our laws. Laws are made for "we-the-people" by our elected representatives. In order to protect our judges from the whims of the public, we insulate them somewhat from the political process. That insulation has become a problem. Judges have used that insulation to dodge accountability for the criminal acts they commit from the bench. In the case of the East Lake Sammamish federal tax fraud scheme, Federal District Judge Barbara Rothstein misused her authority in order to participate in, and cover up, the crime. She counted on the insulation we grant our judges to not be held accountable for her crime. As I write this page, eight years later, she was right.

         I don't choose to have my "hired help" steal from me. When "hired help" steals from an employer, the employer fires that "hired help" and gets someone who will do what they are hired to do. Every judge who participated in the East Lake Sammamish federal tax fraud scheme must be "fired". Those judges must be impeached. There is no "slap on the hand", or censure, or administrative process that will correct this transgression. Impeachment is the only option. I encourage those who share this attitude toward our arrogant judiciary to write their elected representatives in the Washington State and Federal House of Representatives, and request these elected officials familiarize themselves with the East Lake Sammamish federal tax fraud scheme and impeach the judges who participated.

Which Federal and State Judges should be impeached?

    The Federal Judges:

         I spelled out the East Lake Sammamish federal tax fraud scheme with my declaration and exhibits to Federal District Judge Barbara Rothstein. Rothstein struck this evidence of the tax fraud scheme on a motion from King County Prosecutor Norm Maleng, who was one of the participants in the crime. Then, Rothstein issued an opinion that violated my constitutional rights and covered up the tax fraud scheme. I believe that there is no excuse for her actions. Judge Rothstein must be impeached. On appeal, the same information was presented to the three judge Ninth Circuit appeals panel consisting of Senior Circuit Judge Betty Fletcher, Circuit Judge Ronald Gould, and District Judge Mary Murguia. These three judges arrogantly chose to protect Rothstein, rather than uphold their oaths to support the Constitution and the law. They should be impeached. I then spelled out this crime in my Complaint of Judicial Misconduct to Ninth Circuit Chief Judge Mary Schroeder. Schroeder and the other judges who received and ignored this Complaint of Judicial Misconduct must also be considered for impeachment.

    The Washington State Judges:

         East Lake Sammamish neighbors of mine, Jerry and Kathy Ray, took a "sister" lawsuit through the Washington State courts. At the Appeals Court level and at the Washington State Supreme Court, the judges adopted as precedent the federal opinions which hid the East Lake Sammamish federal tax fraud scheme. They were adopted in spite of the serious errors and violation of constitutional rights in those federal decisions. These State judges knew that they were violating the rights of the Rays, and knew they were protecting federal judges and the leadership of King County from taking responsibility for their participation in the East Lake Sammamish federal tax fraud scheme. These State judges intentionally participated in the ELS fraud scheme from the bench. What they did is inexcusable. They must be impeached if the citizens of Washington are to live under the system of Constitution and laws that we have selected to govern ourselves. The Appeals Court judges who are responsible for Ray v. King County (2004), and the judges of the Washington State Supreme Court who denied appeal, must be impeached.       Washington State Judges:

        Court of Appeals, Division One, Judge Ronald E. Cox
        Court of Appeals, Division One, Judge Ann Schindler
        The members of the Washington State Supreme Court when it denied appeal of Ray v. King County (2004)
        The members of the Washington State Supreme Court who refused the request for certification of laws relating to Ray v. King County, from the U.S. Court of Federal Claims in 2005.

         Judges have the duty is to enforce our constitution and laws. Each of these judges intentionally violated the constitutional rights of parties who appeared before them. Each of these judges covered up the ELS federal tax fraud scheme with their opinions or denial of appeal. Each decided that a citizen's constitutional rights are optional to enforce in "their" courts. If we want to live under the Constitution and the law, these judges must be impeached and tried for their criminal actions from the bench. How do we impeach the judges who participated in the East Lake Sammamish federal tax fraud scheme?

         Judges are impeached by our elected representatives. This applies to both federal and state judges, and is authorized by the federal and state constitutions. I'll address the Federal and State processes separately:

    How to impeach a Federal Judge:

      The United States Constitution contains the process for impeaching federal judges:

        United States Constitution, Article 1, Section 2
        The House of Representatives shall choose their Speaker and other Officers; and shall have the sole Power of Impeachment.

        United States Constitution, Article 1, Section 3
        The Senate shall have the sole Power to try all Impeachments.

        United States Constitution, Article 2, Section 4
        The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

           We need to contact our U.S. Representatives to request impeachment of a federal judge. In the U.S. House of Representatives there are two committees involved with judicial impeachments.            I'll resist the temptation to provide a sample letter to a "generic" representative of the U.S. House. If the reader hasn't formed an opinion by the time he/she has got to this place on the page, then I've failed to explain the corruption and dishonesty that has overtaken our courts and government. If the reader wants to leave America in a healthy condition for her/his children and grandchildren, then the hyperlinks shown above are all the resource that is needed to address a thoughtful letter.     How to impeach a Washington State Judge:

      The Washington State Constitution describes the process for impeaching State judges. Here are portions of the Washington State Constitution:

        The Judiciary

        Section 9 - Removal of Judges, Attorney General, ETC. - Any judge of any court of record, the attorney general, or any prosecuting attorney may be removed from office by joint resolution of the legislature, in which three-fourths of the members elected to each house shall concur, for incompetency, corruption, malfeasance, or delinquency in office, or other sufficient cause stated in such resolution. But no removal shall be made unless the officer complained of shall have been served with a copy of the charges against him as the ground of removal, and shall have an opportunity of being heard in his defense. Such resolution shall be entered at length on the journal of both houses and on the question of removal the ayes and nays shall also be entered on the journal.

        Section 11 - Courts of Record. - The supreme court and the superior courts shall be courts of record, and the legislature shall have power to provide that any of the courts of this state, excepting justices of the peace, shall be courts of record.

        Impeachment

        Section 1 - Impeachment - Power of and Procedure. - The House of Representatives shall have the sole power of impeachment. The concurrence of a majority of all the members shall be necessary to an impeachment. All impeachments shall be tried by the senate, and, when sitting for that purpose, the senators shall be upon oath or affirmation to do justice according to law and evidence. When the governor or lieutenant governor is on trial, the chief justice of the supreme court shall preside. No person shall be convicted without a concurrence of two-thirds of the senators elected.

        Section 2 - Officers Liable To. - The governor and other state and judicial officers, except judges and justices of courts not of record, shall be liable to impeachment for high crimes or misdemeanors, or malfeasance in office, but judgment in such cases shall extend only to removal from office and disqualification to hold any office of honor, trust or profit, in the state. The party, whether convicted or acquitted, shall, nevertheless, be liable to prosecution, trial, judgment and punishment according to law.

        Section 3 - Removal From Office. - All officers not liable to impeachment shall be subject to removal for misconduct or malfeasance in office, in such manner as may be provided by law.

           We hire our judges to enforce our Constitution and laws. There is a very narrow area that a judge operates in his/her right to interpret the law. Because we insulate judges from the political process, dishonest judges have worked to expand this very narrow area of interpretation into the right to do whatever they want. The Ray v. King County (2004) opinion in the Washington State Court of Appeals and its subsequent denial of appeal in the Washington State Supreme Court are examples of judges intentionally denying rights under the Constitution, and arrogantly misapplying the law. They have worked to advance their power and influence over citizens because they are not held accountable. It may be human nature to seek power over others, but it isn't allowed by our Constitution or laws. These judges swore oaths to support our Constitution and the laws, and they violated those oaths in their refusal to honestly resolve Ray v. King County. These judges must be impeached because anything less will only encourage their continued denial of the rights of the citizens of Washington State.

           Additionally, there is the Washington State "Commission of Judicial Conduct". This commission is not elected and has no authority to review legal opinions. Since the judges of the Washington State Supreme Court failed the people of Washington in their denial of appeal of Ray v. King County, this commission will refuse to consider their misconduct based only on the merits of that lawsuit. A complaint must be based of a violation of the Code of Judicial Conduct. I suspect that it will be difficult to get this commission to respond, but it may be worth a try to contact the members.
