The Hilchkanum Documents:
Significant Hilchkanum documents related to the King County v. Rasmussen decisions are hyperlinked on the sidebar to the left of this page. The documents are in chronological order and span a twenty-eight year period from June 28, 1876 to June 30, 1904. These documents provide a factual description of this Native American who Federal District Judge Barbara Rothstein irrationally described as the author of his right-of-way deed to the Seattle Lake Shore and Eastern Railway in 1887. Rothstein provided no evidence to support her contrived fact. All of these Hilchkanum documents were provided to Judge Rothstein as exhibits. The documents show Hilchkanum to be a Native American who chose to give up his tribal affiliation so that he could homestead. The documents show that he settled on the wrong lot after he applied for his homestead. They show his inability or unwillingness to deal with legal matters, and his dependence on "white friends" to aid him in his homesteading and real estate transactions. It is obscene that Federal Judge Barbara Rothstein identified Hilchkanum as author of his right-of-way deed in the light of the documents we supplied to the court, the historical disadvantage Natives had in white society at that time, the laws of that time which recognized the disadvantage Natives had in dealing with legal matters, and the lack of any evidence to show Hilchkanum's authorship of his deed. This authorship issue was a disputed material fact which Rothstein had no legal right to resolve. Under the law and Constitution, juries resolve disputed material facts. A legitimate jury would never agree with Rothstein's irrational assignment of Hilchkanum as author of his right-of-way deed. Rothstein's dishonest conclusions are the basis of her opinion that Hilchkanum granted fee simple title of his right-of-way land to the Railway. This dishonest finding hid the East Lake Sammamish federal tax fraud scheme and protected the participants from prosecution.
